Terms of Service

1.Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of saborcup.com and any purchases or subscriptions made through it (the “Service”), operated by SaborCup, Inc. (“SaborCup,” “we,” “us,” or “our”). By accessing the Service, creating an account, or placing an order, you agree to be bound by these Terms. Our Privacy Policy describes how we handle your data.

2.Eligibility

You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract to use the Service. By using it, you confirm that you meet these requirements and that any information you provide is accurate and current.

3.Your account

Some features require an account. You are responsible for keeping your login credentials secure and for all activity under your account. Please provide accurate information, keep it up to date, and tell us promptly of any unauthorized use. We may suspend or close accounts that violate these Terms.

4.Orders & payment

When you place an order, you are making an offer to purchase. We may accept or decline any order and may limit or cancel quantities. Prices are shown at checkout and may change over time. You authorize us to charge your selected payment method for the order total, including applicable taxes and any shipping fees. If a product or price is listed in error, we may correct it or cancel the affected order, even after it is placed.

5.Subscriptions & recurring billing

When you start a subscription, you authorize SaborCup to charge your payment method on a recurring basis for the subscription and cadence you select, until you cancel. Each cycle renews automatically at the then-current price, and we charge around the time your order is prepared for each shipment.

You can pause, skip, change, or cancel anytime from your account before your upcoming roast date; changes take effect on your next shipment. Cancelling stops future charges but does not refund a shipment that has already been roasted or sent. If our prices change, we'll give you notice before the new price applies to your subscription. Continuing your subscription after that means you accept it.

6.Shipping & delivery

We ship according to our Shipping & Returns policy, which is incorporated into these Terms. Delivery dates are estimates, not guarantees. Risk of loss passes to you when the carrier takes possession of your order — though our happiness guarantee still applies if an order arrives damaged or doesn't arrive.

7.Returns, refunds & guarantee

Because coffee is perishable, we handle “returns” through our happiness guarantee rather than asking you to ship beans back — see Shipping & Returns for full details. Refunds, when issued, are applied to your original payment method. Terms for merchandise and gift cards are described in that policy as well.

8.Gift cards & promotions

Gift cards are non-refundable and carry no cash value except where required by law, and they do not expire. Promotional codes and offers may carry their own conditions, cannot be combined unless stated, and may be modified or discontinued at any time. We may refuse or cancel orders that appear to misuse a promotion.

9.Acceptable use

Please use the Service only for lawful, personal, non-commercial purposes. You agree not to resell our products without authorization, scrape or copy the site, interfere with its operation, attempt to gain unauthorized access, or use the Service to harm others. We may suspend or restrict access for misuse.

10.Intellectual property

The site and its content — including text, design, logos, photography, and the SaborCup name and marks — are owned by SaborCup or our licensors and protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to use the site to shop and manage your account. You may not copy, reproduce, distribute, or use our content or marks without our prior written permission.

11.Reviews & user content

If you submit reviews, photos, or other content, you keep ownership of it but grant SaborCup a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and share that content in connection with our business. Please don't post content that is unlawful, infringing, misleading, or offensive. We may remove content or decline to publish it at our discretion.

12.Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties not expressly stated here, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free. Nothing in these Terms limits any rights you have under applicable consumer-protection law.

13.Limitation of liability

To the fullest extent permitted by law, SaborCup will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14.Changes to these terms

We may update these Terms as our business or the law evolves. We will post the revised version with a new “Last updated” date, and we may communicate significant changes by email or on-site notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

15.Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any disputes will be handled in the state or federal courts located in California, unless applicable law requires otherwise. Nothing here removes any non-waivable rights you have under the laws of the place where you live.
